These Fall Season Sale Terms (hereinafter, “Terms”) govern the participation in MailerLite’s Fall Season Sale offering a three-month long 30% discount for New MailerLite services and applicable to Customers on New MailerLite’s free plan (hereinafter, the “Sale”). By participating in the Sale, you agree to be bound by these Terms.
1.1. To be eligible to participate in this Sale, claimants must be registered customers of New MailerLite with an active free plan created before or during the offer period, and must comply with MailerLite’s legal terms that can be found here (hereinafter, “Claimant”). The Sale does not apply to MailerLite Classic plans and to Shopify users who installed the MailerLite Shopify app through the Shopify App Store.
1.2. Customers who were previously on a paid plan but switched to the free plan before the start of the Sale are eligible to claim the discount.
1.3. Participation in the Sale is open to Claimants worldwide, except where prohibited or restricted by national or local law.
2.1. The Sale begins at 7:00 AM UTC on August 26, 2024, and ends at 12:00 AM UTC on October 1, 2024 (hereinafter, the “Sale Period”). The Sale Period can be extended solely by MailerLite.
3.1. During the Sale Period, eligible Claimants will receive a 30% discount applied monthly for a duration of three months, or a 30% discount on annual plans with New MailerLite. During this period, the Claimant will receive a 30% discount on all charges, including any upgrades or changes to the plan.
3.2. For the monthly plans, the Claimant’s discount period starts on the initial purchase day and lasts for three calendar months. For annual plans, Claimants will receive the discount applied to the full 12-month price at the time of the initial purchase and will be valid for any upgrades made within the first three months from the purchase date. This discount period remains fixed and is not affected by any subscription pauses, upgrades, or changes to MailerLite’s plan type.
3.3. The discount cannot be combined with any other discounts, including, but not limited to, annual plan discounts or non-profit discounts.
4.1. MailerLite reserves the right to apply exceptions to this Sale at its own discretion.
4.2. The Sale is not available to MailerLite users on MailerLite Classic plans, users who installed the MailerLite Shopify app through the Shopify App Store, any individuals associated with MailerLite, including employees, service providers, agents, representatives of MailerLite, any paying customers, or when such participation is prohibited or restricted by national or local law.
4.3. Additional exclusions may be determined by MailerLite based on specific checkout behaviors, payment methods, or other circumstances where the Sale cannot be applied.
5.1 MailerLite reserves the right to terminate or modify the Sale at any time at its sole discretion.
5.2. In the event of a violation of MailerLite’s legal terms which can be found here, MailerLite reserves the right to terminate MailerLite’s services without any refund.
5.3. In the event of a conflict between these Terms and any instructions or interpretation of these Terms regarding the Sale, these Terms shall prevail.
5.4. Any disputes arising out of or in connection with these Terms shall be resolved by the courts of the State of Delaware.
