These MailerLite’s Survey Contest Rules (hereinafter - “Rules”) are applicable to the MailerLite Survey Contest (hereinafter - “Contest”).
1. ELIGIBILITY
1.1. To be eligible to participate in this contest, entrants must be a customer of MailerLite. A customer means a person or entity that is registered with MailerLite to use the Services as specified in the Terms of Use (hereinafter - “Customer”).
1.2. Notwithstanding the above, the Contest is not open to individuals associated with the Contest, including the employees, service providers, agents or representatives of MailerLite (excluding affiliate marketers).
1.3. The Contest is open worldwide, except where prohibited or restricted by national or local law.
2. CONTEST PERIOD
2.1. The Contest starts at 0:01 a.m. UTC on 16th of May, 2024 and ends at 11:59 p.m. UTC on 31st of May, 2024. The period of this Contest can be extended by MailerLite solely.
3. HOW TO ENTER
3.1. MailerLite’s customers will be able to access a survey called “Customer Persona Survey” (hereinafter - “MailerLite Survey”) on their MailerLite account or by a newsletter that will be sent to MailerLite’s Customers that have not filled the survey on their account in the first 7 days.
3.2. Participants must complete MailerLite's Survey in its entirety, accurately answering all questions and providing a valid email address to enter the Contest.
4. PRIZES
4.1. Each of the 26 winners (“Winners”) will win one of the following prizes:
4.1.1. 1 x iPad Air;
4.1.2. 10 x $50 gift cards from Tango;
4.1.3. 15 MailerLite swag kits.
4.2. Gift cards, specified in Clause 4.1.2., will be provided via email and can be used via this website: https://www.tangocard.com/reward-link/
4.3. The physical prizes such as the iPad Air and 15 MailerLite swag kits will be sent by registered post.
4.4. Winners will be contacted by the 14th of June, 2024 by email to the email address they have provided when filling out the survey.
4.5. If a potential or declared Winner is not in compliance with these Contest rules, MailerLite reserves the right to disqualify such entrant from the Contest and select an alternative winner.
5. DETERMINATION OF THE WINNERS
5.1. The Winners will be randomly selected by the MailerLite team. Selection of the Winner will be conducted under the supervision of a dedicated team from MailerLite. MailerLite will notify the twenty-six Winners by using the email addresses they have provided whilst filling out the survey.
6. DISQUALIFICATION
6.1. Any attempt to tamper with the entry process and new sign-ups, interfere with these Rules, deliberately damage any website or undermine the administration, security, or legitimate operation of the Contest, is a violation of criminal and civil laws, and MailerLite reserves the right to seek damages and / or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this Contest.
6.2 Failure to provide an accurate, working email account through which MailerLite can contact you will disqualify you from receiving the Contest prize.
6.3 Failure to respond to MailerLite’s attempts to contact the Winner and award them the prize for longer than 10 business days can result in disqualification from receiving the prize.
7. TECHNOLOGY MISHAPS
7.1. MailerLite assumes no responsibility for entries that are lost, stolen, late, delayed, damaged, illegible, incomplete, or for the failure, interruption or delay of any email or other communication to be received, for any reason; problems with the function of any website or website feature howsoever caused; the malfunction of, or damage caused to, computer equipment, data or software, online systems, servers or access providers; any functionality lost due to not having cookies enabled; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”.
8. PERSONAL INFORMATION AND CONTENT MATERIAL
8.1. Please read MailerLite’s Privacy Policy, Security Statement and Cookie Policy to learn more about how we process and protect personal data in accordance with good industry practice.
8.2. By participating in this Contest you agree and confirm your consent that MailerLite is allowed to process your personal data (name, surname, email, address, phone number and / or any other information provided) for the purpose of this Contest.
9. DISPUTES
9.1. Any disputes arising from this Contest shall be settled by negotiations. Any dispute, controversy, or claim arising out of or in connection with this Contest shall be finally settled by the court of the State of Delaware, United States of America. The dispute shall be resolved on the basis of the laws of the State of Delaware, United States of America.
10. MISCELLANEOUS PROVISIONS
10.1. The Contest will be promoted and announced to MailerLite’s Customers and Newsletter subscribers.
10.2. If, for any reason, the Contest is not capable of running as planned, it may be terminated at MailerLite’s sole discretion.
10.3. In the event of a conflict between the Rules and any instructions or interpretation of these rules regarding a Contest, these rules shall prevail.
